Buyer Agency


Historically, all real estate agents represented the seller. This was true when an agent listed a property as well as when an agent assisted a buyer in purchasing property. Since real estate agents represented the seller, agents were obligated to negotiate the best price and terms for the seller.

If you are a future home buyer, you'll be happy to know that now with buyer agency, you can choose to work with a real estate professional who represents you! Working solely in your behalf, your buyer's agent can freely discuss with you the advantages and disadvantages of a particular home, advise you on how much to offer and actively negotiate for you. Your buyer's agent is allowed to share any known information with you, such as the seller's reasons for selling, how long the home has been on the market, previous offers on the home, and whether the seller would accept a lower price.

Buyer agency requires that your agent represent you with loyalty, diligence, confidentiality, obedience, disclosure, accountability and reasonable care. These duties are defined by state law and agency law.

A buyer agency relationship is established with a written agreement between a buyer and real estate professional. Although the commission may be paid by the buyer, usually it is paid by the seller in the traditional manner--as a portion of the sales commission built into the list price.
